Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and the Service Provider ("we", "us", "our"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately cease all use of the Service.

2. Scope of the Service

The Service is a web-based platform enabling users to plan trips, create excursions, upload text and photographic content, participate in groups, and communicate via messaging and chat functionalities.

We reserve the right to modify, restrict, suspend, or discontinue any part of the Service at any time, with or without notice, and without liability.

3. User Accounts and Eligibility

You are solely responsible for all activities conducted through your account. You must ensure that all information provided is accurate and kept up to date.

We may suspend, restrict, or permanently terminate any account at our sole discretion, with or without cause, notice, or explanation.

4. Age Restriction

The Service is not intended for use by persons under the age of 16.

By using the Service, you represent and warrant that you are at least 16 years old. We do not knowingly collect personal data from children under 16. If we become aware that such data has been collected, we may delete it without notice.

5. User-Generated Content

5.1 Sole Responsibility

All content uploaded, published, transmitted, or otherwise made available by users, including text, images, comments, messages, metadata, and location-related information ("User Content"), is the sole responsibility of the user who provided it.

We do not review, verify, endorse, or guarantee the legality, accuracy, quality, or appropriateness of any User Content.

5.2 No Liability

To the maximum extent permitted by law, we disclaim all liability arising from User Content, including but not limited to claims of copyright infringement, privacy violations, defamation, unlawful content, or misuse of personal data.

6. License and Use of User Content

By submitting User Content, you grant us a perpetual, irrevocable, non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, store, copy, modify, adapt, distribute, publish, display, and make available such User Content for the operation, development, analytics, marketing, promotion, and improvement of the Service.

You acknowledge that User Content may be shared with third parties, including service providers, partners, affiliates, authorities, or other users, and that such sharing may continue even after account deletion where legally permissible.

7. Content Moderation and Enforcement

We reserve the absolute right, but not the obligation, to remove, modify, restrict, block, or permanently delete any User Content or account, in whole or in part, at any time, for any reason or no reason, without notice.

We are under no obligation to investigate, respond to, or resolve complaints, reports, or disputes submitted by users or third parties.

8. Copyright Infringement (DMCA-style Policy)

Users represent and warrant that they own or have all necessary rights, licenses, and permissions to upload and share User Content.

If we receive a notice or allegation of copyright infringement or other intellectual property violation, we may remove or disable access to the relevant content immediately, without prior notice, and without obligation to verify the claim.

Repeated or severe violations may result in permanent account termination.

9. Prohibited Conduct

You agree not to:

  • Upload content you do not have the legal right to distribute
  • Infringe intellectual property, privacy, or personal rights of others
  • Upload unlawful, misleading, harmful, or offensive content
  • Harass, threaten, impersonate, or abuse others
  • Attempt to interfere with or compromise the security or integrity of the Service

10. Account Deletion and Data Removal

Users may request account deletion. Upon deletion, we will delete or anonymize personal data without undue delay, unless retention is required or permitted by law.

We reserve the right to retain certain data, including backups, logs, transactional records, and content already shared with third parties, for legal, security, or operational purposes.

Account deletion is permanent and irreversible.

11. Data Protection and GDPR

We process personal data in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Slovak data protection laws.

Users have the right to access, rectify, restrict, or erase their personal data, subject to legal limitations.

12. Service Availability and Warranty Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, express or implied.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components.

13. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including loss of data, loss of content, loss of profits, or reputational harm, arising out of or related to the use of the Service.

14. No Reliance and Route Safety Disclaimer

The Service, including all trips, routes, itineraries, maps, elevation data, difficulty ratings, descriptions, recommendations, and user-generated content, is provided for informational purposes only.

We do not guarantee the accuracy, completeness, safety, legality, or suitability of any routes or trips displayed or suggested through the Service.

You acknowledge and agree that:

  • routes and trips may be inaccurate, outdated, incomplete, or misleading,
  • route difficulty, length, elevation, terrain, and conditions may differ from reality,
  • weather, natural conditions, infrastructure, and accessibility may change at any time.

You use the Service entirely at your own risk. We do not provide professional travel, safety, medical, rescue, or outdoor activity advice.

You are solely responsible for:

  • assessing your physical condition and abilities,
  • evaluating route difficulty and risks,
  • preparing appropriate equipment and safety measures,
  • complying with local laws, regulations, and safety rules.

To the maximum extent permitted by law, we shall not be liable for any injuries, accidents, damages, losses, or death resulting from reliance on information provided through the Service, including routes, trips, or recommendations created by us or by other users.

Any labeling of routes as 'recommended', 'featured', or similar is for informational and organizational purposes only and does not constitute advice or endorsement.

15. Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, damages, liabilities, costs, and expenses arising from your use of the Service, your User Content, or your violation of these Terms or applicable law.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Slovak Republic. Any disputes shall fall under the exclusive jurisdiction of the courts of the Slovak Republic.

17. Online Dispute Resolution

In accordance with Regulation (EU) No 524/2013, consumers may submit complaints via the European Commission's Online Dispute Resolution platform available at: https://ec.europa.eu/odr

18. Changes to the Terms

We may modify these Terms at any time at our sole discretion. Continued use of the Service constitutes acceptance of the updated Terms.

Additional policies, guidelines, disclaimers, and notices made available through the Service, including the Privacy Policy, Community Guidelines, and safety or informational disclaimers, are incorporated by reference and form an integral part of these Terms.

We reserve the right to modify such documents at any time without prior notice.
